Judge rules Freedom of Information Council can intervene in Davenport open records case

A judge has ruled that the Iowa Freedom of Information Council, or FOIC, can intervene for private citizen David Sidran.

The city of Davenport is taking Sidran to court over an ongoing open records case.

The Quad-City Times reports, Judge Henry Latham said Wednesday that the "outcome of this case will affect the interests of the FOIC." And, they have the right to intervene.

Back in February of this year, the city filed a petition with the Iowa District Court to decide if certain public records are classified under Iowa open records law. The records in question include information about harrassment and intimidation by a former city employee and a monetary demand in a letter from Corri Spiegel, former city administrator.

Sidran was named as a defendant in the case because he requested the records through the Freedom of Information Act.

Latham rejected a request to intervene by two former city employees, Tiffany Thorndike and Samantha Torres. They had written similar letters to Spiegel's, that were released by another city employee.

Judge Latham rejected Thorndike and Torres' request to intervene because "Whether the City negligently released Thorndike's and Torres' letters is an independent action."

A setting hearing has been planned for May 14.
