Davenport Wins Court Case

A court battle over open records in Davenport has been won - by the city. In a decision, filed Thursday, District Court Judge Stuart Werling ruled city leaders did not withhold documents requested by Doctor Allen Diercks and Patricia Lane.

In 2012, city leaders began working on a deal to buy the Rhythm City Casino from Isle of Capri, and hired the accounting firm of Deloitte and Touche to examine the casino's financial condition, to let the city know if it was worth the asking price of 46 million dollars.  
After several days of testimony earlier this month, the judge concluded the records were with-held by Deloitte, and not not the mayor, city manager, or city attorney. 
Judge Werling also found Davenport made a good faith effort to comply with the Freedom of Information Act requests. 
And he ordered Diercks and Lane, the plaintiffs, to pay the costs of the case.
