Two Tenants of Collapsed Building Ask Judge to Require Preservation of Demolished Materials

Lexus and Quanishia Berry are suing the city and owner, Andrew Wold. They want to inspect the site and use what they find as evidence.

Two former residents of The Davenport apartment building are again asking a Scott County judge to order the city to preserve materials from the demolished building. Lexus and Quanishia Berry are suing the city and owner, Andrew Wold. They want to inspect the site and use what they find as evidence.

Today, the Berry's attorney submitted an amended emergency motion for a "protective order" which would require "the preservation of all demolished materials."

The City of Davenport has also filed its "resistance" to the motion.

Earlier this week, a Scott County judge denied their initial emergency motion to halt the demolition of the building. But The Davenport, six story apartment building has now been torn down.

A hearing is set for Friday afternoon at 1:30 pm.
