Tate Hearing Cancelled

Davenport School Superintendent Art Tate will not get his "day in court" after all. Tuesday's hearing before an administrative law judge has been cancelled because the administrative law judge has already found him guilty. 

Tate faced charges from the Iowa Board of Educational Examiners because he allowed the school district to spend more than allowed by law. And he very publicly challenged the Iowa school funding formula that requires the Davenport district to spend 175 dollars less per student than many other districts in the state. 

Because of that, state officials asked for a summary judgement, saying no hearing would be necessary because Doctor Tate had admitted breaking the rules. And the judge agreed. 

In a statement from the district, Tate says he's "extremely disappointed that the administrative law judge made a determination of guilt before allowing him to present his case in public." And he's decided to settle the complaint with the state attorney general’s office. 

The proposed settlement will have to be approved by the Board of Educational Examiners. The provisions of the settlement will be made public when the Board of Educational Examiners takes action.
